By taking admission in the four days training of technical analysis in commodities market, you are agreeing to the following terms and conditions. Please read them carefully
Your training at our consultancy is conditioned on your acceptance of and compliance with these Terms. By getting admission you agree to be bound by these Terms. If you disagree with any part of the terms then you may not enroll yourself in our training program.
Restrictions; Use of Services.
The following restrictions apply to your training: (i) you will not engage in any activity related to the training that is contrary to applicable law, regulation or the terms of any agreements you have with MATANGI CONSULTANCY or any other parties; (ii) you will not commercially exploit any part of the training, except as expressly permitted by MATANGI CONSULTANCY; and (iii) all information and materials contained in the training, except where otherwise expressly indicated, are owned and controlled by MATANGI CONSULTANCY. You may not use, modify, copy, distribute, frame, reproduce, republish, download, scrape, publicly display, publicly perform, post, transmit, sell or otherwise exploit any intellectual property or Content appearing on or through the training, or create derivative works based on such Content, in any form or by any means, in whole or in part, without MATANGI CONSULTANCY’ prior written permission, unless expressly permitted elsewhere under these Terms and Conditions. You may not circumvent, disable or otherwise interfere with security-related features of the training or features that prevent or restrict use or copying of any Content or enforce limitations on use of the training or the Content.
Whilegetting the training, you are strictly prohibited from and you are hereby obligated NOT to:
- Write any unsolicited communications or social media reviews or defamatory statements or advertising not expressly authorized by MATANGI CONSULTANCY in writing, including without limitation promotional materials, affiliate marketing, junk mail, spam, or post links to external websites, unless integral to the conversation, as determined by MATANGI CONSULTANCY sole discretion;
- Get the training to impersonate any person or entity, including but not limited to an employee of MATANGI CONSULTANCY or its affiliated companies, or falsely state or otherwise misrepresent yourself, your age or your affiliation with a person or entity;
- instigate or encourage others to commit illegal activities or cause injury or property damage to any person;
- intentionally or unintentionally violate any applicable law;
Use of information and Materials
“MATANGI CONSULTANCY” is an Educational Institution solely providing training to students for “Four days in Technical Analysis in Commodities Market, while we endeavour to keep the information up to date and correct.
This is a training course and not a transfer of title, and under this course you are prohibited:
- modify or copy the materials/videos;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- remove any copyright or other proprietary notations from the materials; or
- transfer the materials to another person or “mirror” the materials on any other server.
IN ANY VIOLATION OF THE TERMS, POSTING OF ABUSIVE POSTS IN SOCIAL MEDIA, WHATSAPP, ABUSIVE AUDIO, THREATENING, DEFAMING BY ANY MEANS WILL MAKE MATANGI CONSULTANCY TO CLAIM DAMAGES OF RS. 10 LACS FROM THE TRAINEE SIGNING ON THIS AGREEMENT WITHOUT PREJUDICE TO OTHER COMPLAINTS/DAMAGES AS PER APPLICABLE LAW.
In no event/ MATANGI CONSULTANCY will be liable for any loss or damage whatsoever arising from loss or profits arising out of or in connection with usage of this training.
Liability for our Services
WE, MATANGI CONSULTANCY, WILL NOT BE RESPONSIBLE FOR LOSS,PROFITS, LOSESS FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES.IN ALL CASES, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT ARISES FROM THE USAGE OF THE TRAINING.
IMPORTANT:
By going through this training you are agreeing to the terms set out above. This training is for educational purposes only and does not intend to give trading/investment advice.
UNDER NO CIRCUMSTANCES WILL MATANGI CONSULTANCY BE RESPONSIBLE OR LIABLE IN ANY WAY FOR ANY CONTENT, INCLUDING BUT NOT LIMITED TO, ANY ERRORS OR OMMISSIONS IN THE CONTENT, OR FOR ANY INJURY, DEATH, LOSS OR DAMAGE OF ANY KIND SUSTAINED BY ANY PERSON AS A RESULT OF ANY CONTENT COMMUNICATED ON SOCIAL MEDIA, WHETHER BY MATANGI CONSULTANCY OR ANY THIRD PARTY.
IN NO EVENT SHALL MATANGI CONSULTANCY BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OR PROFITS ARISING OUT OF OR IN CONNECTION WITH THE AVAILABILITY, USE OR PERFORMANCE OF ANY INFORMATION COMMUNICATED IN THIS TRAINING PROGRAMME.
Miscellaneous.
These Terms and Conditions, which includes the Privacy Policy and Disclaimer, represent the entire agreement between you and MATANGI CONSULTANCY and supersede any and all prior or written or oral agreements between you and MATANGI CONSULTANCY with respect to such subject matter.
There will be no refund made in any circumstances after the complete full payment of the course fees.
No provision of these Terms and Conditions provides any person or entity not a party to these Terms and Conditions with any remedy, claim, liability, reimbursement or cause of action, or creates any other third party beneficiary rights, except as expressly set forth in these Terms and Conditions.
Indemnification.
You agree to indemnify and hold MATANGI CONSULTANCY and their successors and assigns harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including without limitation any lawyers’ fees, arising out of or in connection with:
- Your admission in training other than in accordance with these Terms and Conditions;
- 2. Your conduct, acts and omissions in connection with the training which breach these Terms and Conditions;
- 3. Your violation of these Terms and Conditions, and agreements between you and Matangi Consultancy, including but not limited to intellectual property rights.
The foregoing indemnification obligation will survive these Terms and Conditions and your use of the Services. MATANGI CONSULTANCY shall provide notice to you of any such claim, action or demand.
Disputes; Governing Law; Choice of Forum
Any dispute, controversy or claims arising out of or relating to this Agreement or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the provisions of the [Indian] Arbitration and Conciliation Act, 1996 as amended up to date, the sole arbitrator shall be appointed by the Matangi Consultancy in accordance with the Rules. The cost of arbitration proceedings including the fee of the arbitrator shall be borne by both the parties in equal proportions. The place of arbitration shall be at New Delhi and any award whether interim or final, shall be made, and shall be deemed for all purposes between the Parties to be made in New Delhi. The arbitral procedure shall be conducted in the English language and any award or awards shall be rendered in English. The procedural law of the arbitration shall be Indian law. The award of the arbitral tribunal shall be final, conclusive and binding upon the Parties, and the provisions of the [Indian] Arbitration and Conciliation Act, 1996 as amended up to date, shall apply. The arbitrator will have the authority to award money damages (with interest on unpaid amounts from the date due), specific performance, and temporary injunctive relief, but not the authority to award exemplary or punitive damages, and any claimed right to such damages is expressly waived. The rights and obligations of the Parties under, or pursuant to, this Clause, including the arbitration Agreement in this Clause, shall be governed by and be subject to Indian law, and the Agreement shall be subject to the exclusive jurisdiction of the courts at New Delhi, INDIA.
The terms & conditions of this agreement are subject to Indian law and the parties to the exclusive jurisdiction of the Delhi Courts in connection with any dispute hereunder.
